Under the Clean Air Act, CARB is responsible for developing statewide programs and strategies to reduce smog-forming and toxic pollutants emitted from mobile sources.
Heavy-duty diesel vehicles greater than 14,000 pounds are major contributors to California’s air quality challenges. These vehicles still contribute the majority of on-road NOx and PM 2.5 emissions, despite significant efforts by CARB over the last 40 years to reduce NOx and PM emissions from this sector.
Previous efforts include regulations and programs for new engine standards, manufacturer warranties, and durability requirements for emission control components; in-use truck rules to accelerate fleet turnover; and incentive programs to promote innovative low- and zero-emitting technologies.
Who is a motor carrier for purposes of the BIT Program? A motor carrier is defined in Section 408 of the California Vehicle Code (CVC) as the registered owner, lessee, licensee, or bailee of any vehicle set forth in Section 34500 CVC, who operates or directs the operation of any such vehicle on either a for-hire or not-for-hire basis. Section 34501.12(a) CVC identifies vehicles subject to the BIT program as those described in Section 34500 CVC as listed below: • Any motortruck of three or more axles that are more than 10,000 pounds Gross Vehicle Weight Rating (GVWR). • Truck tractors. • Trailers and semitrailers, pole or pipe dollies, auxiliary dollies, and logging dollies used in combination with vehicles listed above. This subdivision does not include camp trailers, trailer coaches, and utility trailers. • A combination of a motor truck with a GVWR of more than 10,000 pounds, while towing any trailer listed above, which exceeds 40 feet in length when coupled together. Combinations which include a pickup truck as defined in Section 471 CVC or which are never operated in commercial use are excluded. • A commercial motor vehicle with a GVWR of more than 26,000 pounds or a commercial motor vehicle of any GVWR towing trailers listed above with a GVWR of more than 10,000 pounds, except combinations including camp trailers, trailer coaches, or utility trailers. • A vehicle, or a combination of vehicles, transporting hazardous materials for which the display of placards, a California hazardous materials transportation license, or a California hazardous waste transporter registration is required. • Any other motortruck not specified above that is regulated by the Department of Motor Vehicles (DMV) Motor Carrier Permit (MCP), Public Utilities Commission (PUC), or FMCSA.
Periodic vehicle inspections (Section 34505.5 CVC) Carriers must ensure each regulated vehicle is inspected at least every 90 days, or more often if necessary to ensure safe operation. Vehicle inspections must be documented and retained for at least two years. At a minimum, the following items must be inspected: • Brake adjustment. • Brake system components and leaks. • Steering and suspension systems. • Tires and wheels. • Vehicle connecting devices. At a minimum, each periodic inspection report must include: • Identification of the vehicle, including make, model, license number, company vehicle number, or other means of positive identification. • Date and nature of each inspection and any repair performed. • Signature of the motor carrier’s authorized representative attesting to the inspection and to the completion of all required repairs.
Annual Inspection – §396.17 Every commercial vehicle, including each segment of a combination vehicle requires periodic inspection that must be performed at least once every 12 months. At a minimum, inspections must include all items enumerated in the Minimum Periodic Inspection Standards, Appendix G to Subchapter B of the Federal Motor Carrier Safety Regulations. Motor carriers may perform required annual inspection themselves. The original or a copy of the periodic inspection report must be retained by the motor carrier for 14 months from the report date.
Inspector Qualifications:
Inspectors Must Understand Part 393 and Appendix G – Motor carriers must ensure that persons performing annual inspections are qualified. Inspectors must understand the inspection standards of Part 393 and Appendix G and be able to identify defective components, and have knowledge and proficiency in methods, procedures, and tools.
Brake inspector qualification – The motor carrier is responsible for ensuring that all inspections, maintenance, repairs, and service to brakes of commercial motor vehicles comply with these regulations. The carrier must ensure that the employees responsible for brake inspection, maintenance, service, or repairs meet minimum brake inspector qualifications.
Qualifying Brake Training or Experience – Qualifying brake training or experience includes successful completion of a State, Canadian province, Federal agency, or union training program, a State-approved training program, training that led to attainment of a State or Canadian Province qualifying certificate to perform assigned brake service or inspection tasks, including passage of CDL air brake test in the case of a brake inspection, or one year of brake-related training, experience, or combination of both.
Maintaining Evidence of Brake Inspector Qualifications – Motor carriers must maintain evidence of brake inspector qualification at the principal place of business or the location where the inspector works. Evidence must be retained for the period during which the brake inspector is employed in that capacity, and for one year thereafter.

Previous efforts include regulations and programs for new engine standards, manufacturer warranties, and durability requirements for emission control components; in-use truck rules to accelerate fleet turnover; and incentive programs to promote innovative low- and zero-emitting technologies.
Modern heavy-duty diesel vehicles are equipped with after treatment systems like diesel particulate filters for controlling PM and selective catalytic reduction for cutting NOx emissions. However, when emissions control components malfunction, this may result in emissions increases that can stall efforts to achieve clean, healthy air in California’s communities. The Clean Truck Check will ensure heavy-duty vehicles operating in California are well-maintained and repaired rapidly when needed, and promote a level playing field for the businesses that operate them.
Through an integrated strategy combining roadside emissions monitoring to screen for potential high-emitting vehicles, improved emissions testing procedures using on-board diagnostics data, emissions checks and data reporting at required intervals, and compliance verification requirements for freight contractors, seaports, and railyards, the Clean Truck Check regulation is one of the most impactful regulations approved in recent CARB history. When fully implemented, the regulation is projected to cut statewide NOx emissions by over 81 tons per day and PM emissions by 0.7 tons per day in 2037. Together, these emissions reductions will result in over 7,500 avoided premature deaths.
